Sales Tax

Taxes that appear on your online order are approximate. The actual taxes charged to your credit card will reflect the applicable state and local sales taxes, and will be calculated when your order is shipped. Orders shipped to AL, AZ, AR, CA, CO, CT, DC, FL, GA, IL, IN, IA, KS, KY, LA, ME, MD, MS, MO, NE, NV, NM, NY, NC, OH, OK, PA, SC, SD, TN, TX, UT, VT, VA, WA will have all applicable local and state sales taxes added to your total order, and to your shipping charges where appropriate.

To be clear, the Internet Tax Freedom Act (ITFA), which was signed into law on October 21, 1998, does not, as some have asserted, preclude sales and use taxes on any and all commerce conducted over the Internet. State and local governments are allowed to impose sales and use taxes on all such electronic sales, provided that the tax (and its rate) are the same as that which would be imposed on the transactions if they were conducted in a more traditional manner, such as over the phone or through mail order.

The ITFA is intended to prevent any jurisdiction from imposing special taxes on Internet transactions, other than such taxes that a jurisdiction already has the ability to impose. The ITFA prevents the imposition of any such taxes through November 1, 2014.

Currently, most e-commerce companies use the same taxation rules used by mail-order companies, which are based on constitutional guidelines for interstate commerce. Generally this means that states can only require companies to collect sales tax in states where they have business operations, and as a result, a company will not collect sales tax in states where they have no business operations. If someone were to order something from one of our catalogs, that person would only be charged sales tax if he or she shipped his or her order to a state where our parent company has physical operations.

The ITFA also prohibits state and local governments from imposing taxes on Internet access charges, protects against the imposition of new tax liability for consumers and vendors involved in commercial transactions over the Internet, and creates a temporary commission to study taxation of Internet commerce and to report back to Congress in 18 months on whether the Internet ought to be taxed and, if so, how taxes can be applied without subjecting the Internet and electronic commerce to special, discriminatory, or multiple taxation.

Shipping - Domestic

For orders shipping to the US:  Standard shipping is via UPS Ground.  Shipping charges will be calculated as follows:

• orders up to $100 - Shipping is $6.00
• orders between $100.01 and $300 - Shipping is $9.00
• orders between $300.01 and $500 - Shipping is $12.00
• orders above $500 - Shipping is $15.00
• Second business day (order placed by 2pm EST), add $12.00 to standard delivery charge
• Next business day (order placed by 2pm EST), add $20.00 to standard delivery charge

Hart Schaffner Marx can not guarantee expedited shipping on sale items. Orders placed after 2:00 EST will be shipped the following day.

Shipping - International

Hart Schaffner Marx has partnered with a trusted third party, International Checkout, to serve our customers worldwide.

To place an order for international shipment, browse our web site and add items to your cart as usual. On the shopping cart page, there is a button that reads "International Checkout". After you have added all the items you wish to purchase to your cart, click that button.

The contents of your Hart Schaffner Marx cart will be transferred to your cart at InternationalCheckout.com. Complete the order process at International Checkout. The friendly and professional people at International Checkout will process your order.

Returns

Prices shown are available online only and may differ from those in our stores. Quantities, sizes and colors are limited to stock in the online store, and may differ from those in our retail stores. Our normal shipping fees apply. Prices final on day of purchase. Previous purchases are not eligible for this discount. While intermediate markdowns may have been made previously, all reductions are based on original prices.

Hart Schaffner Marx reserves the right to add or remove items from our Web site, at any time, at our discretion. Product selections offered during promotional periods may differ from product selections offered during non-promotional periods.

Hart Schaffner Marx will accept returns within 60 days of purchase as long as the item is not worn or altered for refund or exchange if accompanied by the proper sales receipt. Refunds will be paid by credit to the original credit card. If the item is returned after 60 days, merchandise credit will be issued. If the item is found to have been worn or altered, management will determine if the garment can be salvaged. If it is determined that the garment cannot be resold, no refund or exchange will be approved. Shipping charges are not refundable. Merchandise purchased online or through the catalog may not be returned to a retail location.

To Process a Return (Non-Tailored Items Only) Return Form

• Enclose the Return Form along with the merchandise and copy of the original packing slip in a secure package.
• Attach the Return Label to the outside and return through any insured shipper.
• If you do not have the Return Label please address your package to the address on Return  form.
• Return postage is not paid, customer is responsible for postage.
• Please allow 30 days for us to receive your return and process your request.

For Tailored Items (Suits/Sportcoats/Trousers) Return Form

• Enclose the Return Form along with the merchandise and copy of the original packing slip in a secure package.
• Attach the Return Label to the outside and return through any insured shipper.
• If you do not have the Return Label please address your package to the address on Return  form.
• Return postage is not paid, customer is responsible for postage.
• Please allow 30 days for us to receive your return and process your request.

Price Adjustments

Price adjustments will be accepted within 10 days from the ship date. Price adjustments are accepted on items purchased at the full retail price only. Items purchased on sale or with a promotional discount, are not eligible for further price adjustment.
